1. INTRODUCTION
Welcome to Just Borrow That ("Platform," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Just Borrow That platform, website, and services. By accessing or using our Platform, you agree to be bound by these Terms.
Just Borrow That operates as a peer-to-peer rental marketplace connecting owners/lenders ("Owners") with renters ("Renters") for the temporary rental of items.
2. DEFINITIONS
"Owner" or "Lender": A user who lists items for rent on the Platform
"Renter": A user who rents items from Owners through the Platform
"User": Any person who accesses or uses the Platform, including both Owners and Renters
"Item": Any product, equipment, or goods listed for rent on the Platform
"Rental Transaction": The complete process of renting an item, from booking through return
"Service Fee": The fee charged by JustBorrowThat for use of the Platform
"Security Deposit": A refundable amount held to cover potential damage or loss of a rented item
3. ELIGIBILITY
To use Just Borrow That, you must:
Be at least 18 years of age
Have the legal capacity to enter into binding contracts
Provide accurate and complete registration information, including a profile photo
Maintain the security of your account credentials
4. FEES AND PAYMENT TERMS
4.1 Service Fee
Just Borrow That charges a service fee on all rental transactions. The current service fee structure is:
Owner Fee: 10% of the rental amount (deducted from the Owner's payout)
Renter Fee: 12% of the rental amount (added to the Renter's total at checkout)
Total Platform Fee: 22% (10% from Owner + 12% from Renter)
Service fees are subject to change with 30 days' notice to users
Example: For a $100 rental:
Renter pays: $100 (rental) + $12 (service fee) = $112 total
Owner receives: $100 (rental) - $10 (service fee) = $90 payout
Platform receives: $10 + $12 = $22 total service fee
4.2 Payment Processing Fee
All payments are processed through Stripe, our third-party payment processor. Stripe charges a processing fee for each transaction, which is:
Standard Stripe processing fee: 2.9% + $0.30 per transaction
This processing fee applies to all rental payments
Processing fees are automatically calculated and included in the transaction
4.3 Security Deposit Terms
For Owners/Lenders:
When an Owner elects to require a security deposit for their rental listing:
The Owner has the option to enable a security deposit feature for any listed item
The Owner is responsible for paying the Stripe processing fee associated with holding and returning the security deposit
The security deposit amount is set by the Owner based on the item's value and condition
The processing fee for the security deposit is separate from the rental payment processing fee
This fee structure ensures Owners maintain control over security requirements while bearing the associated costs
For Renters:
If a security deposit is required, the full deposit amount will be authorized on your payment method at the time of booking
The security deposit is held securely by Stripe during the rental period
The security deposit is automatically returned to the Renter once:
The item is returned on time
The item is returned in the same condition as when rented (normal wear and tear excluded)
The Owner confirms receipt and condition of the returned item
Security deposit returns typically process within 5-7 business days after confirmation
If the item is damaged, lost, or not returned, the Owner may claim all or part of the security deposit through our dispute resolution process
4.4 Payment Timeline
Renters are charged the rental amount plus the 12% service fee at the time of booking confirmation
Owners receive their payout (rental amount minus 10% service fee) within 3-5 business days after the rental return is confirmed
All payments are processed in USD
4.5 Refunds and Cancellations
Cancellation policies are set by individual Owners
Refund amounts depend on the timing of cancellation and the Owner's stated policy
Service fees are non-refundable except in cases of Platform error or fraud
Security deposits are always fully refundable when return conditions are met
5. OWNER RESPONSIBILITIES
As an Owner listing items on JustBorrowThat, you agree to:
Accurately describe all items, including condition, specifications, and any defects
Set fair and reasonable rental prices and security deposit amounts
Ensure items are clean, safe, and in working condition
Respond promptly to rental requests and Renter communications
Honor confirmed bookings unless extraordinary circumstances arise
Provide clear pickup and return instructions
Inspect items upon return and report damage within 48 hours
Maintain appropriate insurance on high-value items
Understand that you are responsible for Stripe processing fees on security deposits when you elect to require them
Comply with all local laws and regulations regarding rental of items
6. RENTER RESPONSIBILITIES
As a Renter using items from the Platform, you agree to:
Treat rented items with reasonable care
Use items only for their intended purpose
Return items on time and in the same condition as received
Pay all applicable fees, including rental amount and security deposit if required
Report any damage or issues immediately to the Owner and Platform
Follow all safety instructions and guidelines provided by the Owner
Not sublet or share rented items without Owner permission
Understand that security deposits will be returned once items are returned undamaged
7. SECURITY DEPOSITS
7.1 Purpose and Authorization
Security deposits protect Owners against damage, loss, or late return of rented items. When a security deposit is required:
The deposit amount is authorized (not charged) on your payment method
The authorization holds the funds but does not withdraw them
Authorizations typically remain active for the rental period plus 7 days
7.2 Security Deposit Return Process
Automatic Return:
Security deposits are automatically returned to Renters when the item is returned on time and undamaged
The Owner must confirm receipt and condition within 48 hours of return
If the Owner does not report any issues within 48 hours, the security deposit is automatically released
Returns process within 5-7 business days after release
Damage Claims:
If an item is damaged, the Owner must submit a damage claim with photographic evidence within 48 hours of return
Just Borrow That will review the claim and determine the appropriate deduction from the security deposit
Renters have the right to dispute damage claims with evidence
Any unused portion of the security deposit is returned to the Renter
7.3 Lost or Stolen Items
If an item is lost or stolen during the rental period, the full security deposit may be claimed
The Renter must file a police report for items valued over $500
Additional charges beyond the security deposit may apply if item value exceeds the deposit amount
8. PROHIBITED ITEMS AND ACTIVITIES
The following items and activities are strictly prohibited on Just Borrow That:
Prohibited Items:
Weapons, firearms, or ammunition
Illegal drugs or drug paraphernalia
Stolen property or counterfeit goods
Items that violate intellectual property rights
Hazardous materials or explosives
Living animals (except approved pet equipment)
Adult content or sexually explicit materials
Prohibited Activities:
Fraudulent listings or misrepresentation of items
Harassment or abusive behavior toward other users
Attempting to circumvent Platform fees by conducting transactions off-platform
Using the Platform for illegal purposes
Creating multiple accounts to evade bans or restrictions
Manipulating reviews or ratings
9. DISPUTE RESOLUTION
9.1 Communication First
Users are encouraged to resolve disputes directly through Platform messaging.
9.2 Platform Mediation
If direct resolution fails, either party may request Platform mediation:
Submit a dispute request through your account dashboard
Provide all relevant evidence (photos, messages, receipts)
Just Borrow That will review and make a determination within 5-7 business days
Decisions regarding security deposit deductions are final and binding
9.3 Arbitration
For disputes that cannot be resolved through mediation, parties agree to binding arbitration in accordance with the laws of the State of Illinois.
10. LIABILITY AND INSURANCE
10.1 Platform Liability
Just Borrow That operates as a marketplace platform and:
Does not own, sell, or rent any items listed on the Platform
Is not a party to rental agreements between Owners and Renters
Makes no warranties regarding the quality, safety, or legality of items
Is not liable for damages, injuries, or losses arising from rental transactions
Recommends users maintain appropriate insurance coverage
10.2 User Liability
Users are solely responsible for:
The condition and safety of items they list or rent
Any injuries or damages resulting from item use
Compliance with all applicable laws and regulations
Maintaining adequate insurance coverage
Any tax obligations arising from rental income or expenses
10.3 Limitation of Liability
To the maximum extent permitted by law, Just Borrow That's total liability for any claims arising from these Terms or use of the Platform shall not exceed the total service fees paid by the user in the twelve (12) months preceding the claim.
11. INTELLECTUAL PROPERTY
11.1 Platform Content
All content on the Just Borrow That Platform, including logos, designs, text, graphics, and software, is the property of Just Borrow That or its licensors and is protected by copyright, trademark, and other intellectual property laws.
11.2 User Content
By posting content to the Platform (photos, descriptions, reviews), you:
Grant Just Borrow That a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content
Represent that you own or have permission to post the content
Agree that your content does not violate any third-party rights
12. PRIVACY AND DATA PROTECTION
Your use of Just Borrow That is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection, use, and sharing of your information as described in the Privacy Policy.
13. TERMINATION
13.1 User Termination
You may terminate your account at any time by contacting support@justborrowthat.com. Upon termination:
You must complete or cancel all pending rentals
Outstanding fees remain due and payable
Security deposits on active rentals remain in effect
13.2 Platform Termination
Just Borrow That reserves the right to suspend or terminate accounts that:
Violate these Terms
Engage in fraudulent or illegal activity
Receive multiple valid complaints from other users
Remain inactive for extended periods
14. MODIFICATIONS TO TERMS
Just Borrow That reserves the right to modify these Terms at any time. We will provide notice of material changes by:
Posting updated Terms on the Platform with a new "Last Updated" date
Sending email notification to registered users
Requiring acceptance of new Terms upon next login
Continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.
15. GOVERNING LAW
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any legal action or proceeding related to these Terms shall be brought exclusively in the courts located in Cook County, Illinois.
16. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Just Borrow That regarding use of the Platform and supersede any prior agreements.
